These Terms of Service (the “Terms”) govern your use of www.qslean.com (the “Site”) and any message program we operate, both owned and operated by QS Lean Thinking SA de CV (“QS Consulting”, “we”, “us” or “our”). By using the Site or by opting in to receive messages from us, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
1. Acceptance of these Terms
You must be at least 18 years old and able to enter into a binding contract to use the Site. If you use the Site on behalf of an organisation, you confirm that you are authorised to bind that organisation, and “you” means both you and that organisation.
2. Permitted use of the Site
The Site is provided for your information and for legitimate business enquiries. You agree not to:
- Use the Site for any unlawful purpose, or in breach of any applicable law or regulation.
- Submit false, misleading or impersonated information, including a phone number you are not authorised to use.
- Attempt to gain unauthorised access to the Site, its servers or any connected system.
- Introduce malware, or interfere with the operation, integrity or availability of the Site.
- Scrape, harvest or systematically extract content or contact data from the Site.
- Copy, reproduce, republish or resell any part of the Site except as permitted in section 6.
3. SMS and text messaging program terms
QS Lean Thinking SA de CV operates a text messaging program through its messaging platform. These terms apply whenever you receive text messages from us.
3.1 Program descriptionWe send two types of text message, and both are named in the single consent disclosure you agree to when you opt in. Marketing content is never presented as transactional.
Promotional. Special offers, discounts, event promotions and service announcements.
Customer care. Responses to support requests, ticket updates, appointment coordination and follow up communications relating to an existing enquiry or engagement.
3.2 How you opt in
You opt in by visiting the Site, interacting with our chat widget, voluntarily providing your mobile phone number, and ticking the consent checkbox. The checkbox is unchecked by default and is never pre-selected on your behalf. Consent is not a condition of purchasing any goods or services from us. After you opt in you will receive a confirmation message.
3.3 Message frequency and cost
Message frequency varies and depends on your interaction with us. Message and data rates may apply. Your mobile carrier, not QS Lean Thinking SA de CV, is responsible for any charges to your account. Check your mobile plan if you are unsure of your rates.
3.4 How to stop messages (opt out)
Reply STOP to any message from us at any time to unsubscribe. You may also send STOP, END, CANCEL, UNSUBSCRIBE or QUIT. After you send one of these, we will send a single confirmation message and then stop sending messages from that program. To rejoin, opt in again through the Site.

3.5 Carrier disclaimer
Mobile carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your mobile carrier and is outside our control. We do not guarantee that any message will be delivered, or delivered on time.
3.6 Your obligations
You confirm that the mobile number you provide belongs to you, or that you are authorised to give consent for it, and that you will notify us if the number is reassigned or you no longer wish to receive messages at it. You are responsible for keeping your contact details accurate.
3.7 Privacy of mobile data
No mobile information will be sold, rented or shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties for their own purposes. See the Privacy Policy for the full statement.
4. Email communications
If you give us your email address, we may send you emails relating to your enquiry or engagement. Marketing emails are sent only with your consent and always include an unsubscribe link. Unsubscribing from marketing emails does not stop emails that are necessary to deliver a service you asked for.
5. Consulting services and no engagement
The Site describes our consulting services, methods and past work. Nothing on the Site is an offer capable of acceptance, and using the Site, booking a call or exchanging messages with us does not create a consulting engagement or any other professional relationship. An engagement begins only when both parties sign a written agreement that sets out scope, deliverables, fees and terms. That agreement governs the engagement, and if it conflicts with these Terms, the agreement prevails for the work it covers.
Case studies, metrics and outcomes shown on the Site describe results achieved by specific clients under specific conditions. They are not a promise, guarantee or prediction of the results you will achieve.
6. Intellectual property
The Site and all of its content, including text, graphics, logos, page design, frameworks, methods and downloadable materials, are owned by QS Lean Thinking SA de CV or its licensors and are protected by intellectual property law. You may view the Site and print or download individual pages for your own internal, non commercial reference. All other use, including reproduction, modification, distribution, public display and creation of derivative works, requires our prior written permission.
The QS Consulting name, logo and any product or method names appearing on the Site are our trademarks. Any third party names or logos shown are the property of their respective owners and are used for identification only.
7. Third party services and links
We use third party providers to run parts of the Site and our communications, including LeadConnector (a HighLevel product) as our CRM, chat widget and messaging platform. The Site may also link to third party websites and scheduling tools. We do not control those services and are not responsible for their content, availability, terms or privacy practices. Your use of them is governed by their own terms.
8. Disclaimers
The Site and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non infringement, accuracy and uninterrupted or error free operation.
Content on the Site is general business information. It is not legal, financial, tax or accounting advice, and it does not take account of your specific circumstances. Do not act on it without appropriate professional advice.
9. Limitation of liability
To the fullest extent permitted by law, QS Lean Thinking SA de CV, its officers, employees, contractors and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or in connection with your use of the Site or any message program, whether based in contract, tort, statute or any other theory, and whether or not we were advised of the possibility of such damages.
Our total aggregate liability arising out of or in connection with the Site and any message program will not exceed one hundred United States dollars (USD 100). Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
10. Indemnification
You agree to indemnify and hold harmless QS Lean Thinking SA de CV and its officers, employees, contractors and agents from any claim, demand, loss, liability, cost or expense, including reasonable legal fees, arising out of your breach of these Terms, your misuse of the Site, or your submission of a phone number or other information you were not authorised to provide.
11. Privacy
Our Privacy Policy explains how we collect, use, share and protect personal information, and it forms part of these Terms.
12. Suspension and termination
We may suspend or withdraw all or part of the Site, or block your access to it, at any time and without notice, including where we reasonably believe you have breached these Terms. Sections 6, 8, 9, 10, 13 and 15 survive any termination.
13. Governing law and venue
These Terms and any dispute arising out of or in connection with them are governed by the laws of the United Mexican States, without regard to conflict of law rules. Any dispute will be submitted to the exclusive jurisdiction of the competent courts of Mexico City, Mexico, and you expressly waive any other jurisdiction that may correspond to you by reason of your present or future domicile
14. Changes to these Terms
We may update these Terms at any time. The effective date at the top of the page shows when they last changed. Your continued use of the Site, or continued participation in a message program after a change, means you accept the updated Terms. If you do not accept them, stop using the Site and reply STOP to any message.
